Torn rotator cuff with surgery and neck and back soft tissue injuries

Three-vehicle collision. Bus rear-ends an SUV, which spins across the road into the path of plaintiff’s minivan

Verdict: $400,000 verdict (2013)

This multiple vehicle collision was caused when a Middle Country School District bus rear-ended an SUV. That SUV then spun across the road into the path of the plaintiff, who hit it head on.

The plaintiff suffered a torn rotator cuff that required surgery, and also suffered significant neck and back soft tissue injuries that caused both pain and a reduction in her range of motion.

At trial, the defendant’s orthopedic expert claimed that the plaintiff was exaggerating her range of motion loss, when compared with normal ranges of motion. On cross-exam, the defense expert was then confronted with the fact that he had used different “normal” ranges of motion in another case, exposing him to be the exaggerator.
